01协议的接受
下载、安装或使用 NoteOwl（中文名「书记官」，下称「本应用」）即表示你同意本协议。本应用经 Apple App Store 分发，Apple 的标准《许可应用最终用户许可协议》（Licensed Application EULA）同时适用；两者不一致时，在法律允许范围内以本协议为准。Apple 不是本协议的当事方，对本应用及其内容不承担任何责任。
02许可
我们授予你一项个人的、不可转让的、非排他的许可，供你在你拥有或控制的 Apple 设备上使用本应用。你不得对本应用进行反编译、逆向工程、转售、出租或再分发（法律强制允许的除外）。
03你的内容归你
你用本应用录制的音频、拍摄的照片、生成的转写与笔记（下称「用户内容」）完全归你所有，并且只存在于你的设备上。我们不获取、不存储、不主张对用户内容的任何权利。
04录音合规（重要）
你是录音行为的唯一责任人。使用本应用录音时，你必须：
- 遵守你所在司法辖区关于录音/窃听的法律（多数地区要求至少一方或全体在场者知情同意）；
- 在录制他人讲话前取得其知情同意；
- 遵守你所在学校、公司或活动主办方关于录音的规定。
因你违反上述要求产生的一切法律后果由你自行承担。本应用会在首次录音时提示合规义务，并在录制中始终显示红点标识。
05AI 生成内容的准确性
转写与笔记整理由自动语音识别和 AI 模型生成，可能存在错误、遗漏或偏差。笔记中的每一块内容都保留了对原始录音的时间锚点——重要场合（考试复习、会议纪要、法律或医疗等专业用途）请点击回听核对原声。本应用的输出不构成任何专业建议。
06云端增强与第三方服务
云端增强功能允许你把选定的文本发送给你自己选择并配置的第三方大模型服务商（Anthropic、OpenAI、Google，或自建 Ollama）。你与该服务商之间的关系（包括费用、配额、内容政策与数据处理）由其自己的条款约束；我们对第三方服务的可用性、质量与行为不作担保、不承担责任。
07免费层与 Pro 付费
- 本应用首发免费。若后续启用付费，免费层包含每自然月固定场次的完整录制；已录制内容的回听、查看与导出永不因付费状态上锁。
- Pro（订阅或终身买断）通过 Apple App Store 内购完成。订阅按所选周期自动续订，可随时在系统「设置 → Apple 账户 → 订阅」中取消；取消在当前计费周期结束后生效。退款事宜由 Apple 按其政策处理。
- 价格与权益可能调整；调整前已购买的权益按购买时的约定执行。
08免责声明与责任限制
本应用按「现状」提供，不对不间断、无错误运行作出保证。在适用法律允许的最大范围内，我们对因使用或无法使用本应用造成的任何间接、附带、特殊或后果性损失不承担责任；我们的全部责任以你为本应用实际支付的金额为上限。请自行对设备做好备份——用户内容只存在于你的设备上，设备丢失或未备份导致的数据丢失无法由我们恢复。
09终止
你可随时删除本应用以终止本协议。若你实质性违反本协议，我们可终止你的许可。第 03、04、08 条在协议终止后继续有效。
10协议变更
我们可能更新本协议，更新后会修改本页生效日期；重大变更会在应用内提示。变更后继续使用即视为接受。
11适用法律与联系方式
本协议适用开发者所在地法律，同时不影响你作为消费者依常居地强制性法律享有的权利。问题请联系：[email protected]
01Acceptance
By downloading, installing or using NoteOwl ("the App"), you agree to these terms. The App is distributed via the Apple App Store, and Apple's standard Licensed Application EULA also applies; where they conflict, these terms prevail to the extent permitted by law. Apple is not a party to these terms and bears no responsibility for the App or its content.
02License
We grant you a personal, non-transferable, non-exclusive license to use the App on Apple devices you own or control. You may not decompile, reverse-engineer, resell, rent or redistribute the App, except where the law mandates otherwise.
03Your Content Is Yours
Audio you record, photos you take, and transcripts and notes generated with the App ("User Content") belong entirely to you and exist only on your device. We do not receive, store, or claim any rights over User Content.
04Recording Compliance (Important)
You are solely responsible for your recording activity. When recording with the App, you must:
- comply with the recording/eavesdropping laws of your jurisdiction (most require consent of at least one party, or of all parties present);
- obtain informed consent before recording another person's speech;
- follow the recording rules of your school, employer or event organizer.
All legal consequences of failing to do so are yours. The App shows a compliance notice on first recording and always displays a red indicator while recording.
05Accuracy of AI-Generated Content
Transcripts and organized notes are produced by automatic speech recognition and AI models and may contain errors, omissions or bias. Every note block keeps a time anchor into the original recording — for anything important (exam prep, meeting minutes, legal or medical use), tap to replay and verify against the original audio. The App's output is not professional advice.
06Cloud Enhancement and Third-Party Services
Cloud Enhancement lets you send selected text to a third-party AI provider that you choose and configure (Anthropic, OpenAI, Google, or self-hosted Ollama). Your relationship with that provider — including fees, quotas, content policies and data handling — is governed by its own terms; we make no warranty and accept no liability for third-party services.
07Free Tier and Pro
- The App is free at launch. If paid features are later enabled, the free tier includes a fixed number of full recordings per calendar month; replay, viewing and export of already-recorded content are never locked behind payment.
- Pro (subscription or lifetime purchase) is handled via Apple App Store in-app purchase. Subscriptions auto-renew for the chosen period and can be cancelled anytime in Settings → Apple Account → Subscriptions; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under its policies.
- Prices and benefits may change; benefits already purchased remain as agreed at the time of purchase.
08Disclaimer and Limitation of Liability
The App is provided "as is", without warranty of uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from use of or inability to use the App, and our total liability is capped at the amount you actually paid for the App. Please back up your device — User Content exists only on your device, and we cannot recover data lost to a lost or unbacked-up device.
09Termination
You may terminate these terms at any time by deleting the App. We may terminate your license if you materially breach these terms. Sections 03, 04 and 08 survive termination.
10Changes
We may update these terms; the effective date on this page will change accordingly, and significant changes will be announced in the App. Continued use after a change constitutes acceptance.
11Governing Law and Contact
These terms are governed by the law of the developer's place of business, without affecting mandatory consumer protections of your place of residence. Questions: [email protected]
